Acceptance of an Invoice, booking or service from Waste M8 Pty Ltd trading as WASTEM8.net.au (herein referred to as ‘WASTEM8’) is acceptance of the below Terms & Conditions.
WASTEM8 Cancellation Policy
Cancellations are permitted at no charge if cancelled at least 24 hours prior to the scheduled booking date and time.
For cancellations made within 24 hours of your booking date and prior to the commencement of the service or upon arrival of our service team, WASTEM8 reserves its right to charge a cancellation fee of $150. This cancellation service fee is charged at the discretion of the WASTEM8 team.
Cancellations and unloading of waste after WASTEM8 has commenced any of its services are permitted but are subject to a cancellation fee of $150. Any questions regarding this cancellation policy can be directed to info@wastem8.net.au.
Payment Policy
All payments are to be made once the WASTEM8 waste removal service is completed. Payments are to be via debit or credit card only as directed by the WASTEM8 team.
For HVAC pickup bookings, payment is due 7 days after collection.
In the event that your job is cancelled, the client expressly provides WASTEM8 with the right to charge a cancellation fee of $150, plus any applicable costs incurred to return and unload either the client's waste collected or the equivalent volume or value of waste to the property if, in fact, the client's original waste collected has been processed already for recycling and/or landfill. This is payable immediately, and failure to pay will result in further debt recovery and legal action.
Costs Clause
I/We acknowledge that if the account is overdue, WASTEM8, at its discretion, reserves the right to refer the account to a Mercantile Agency for collection and I/we agree that all costs chargeable by the agency (as if the account had been collected by the agency) will be added to the account. Legal costs incurred by WASTEM8 to collect the account will be recoverable “on an indemnity basis” and will form part of the debt.
Invoices are subject to the discretion of WASTEM8 and, unless otherwise agreed for an approved commercial account, are to be paid within 7 days of the invoice date. Payment remittance is to be sent to info@wastem8.net.au. Late payment fees apply.
Late payment fees are as follows – 5% of the total invoice amount for accounts greater than 30 days late. All accounts that remain outstanding are subject to interest, calculated monthly and levied at a rate equivalent to the General Interest Charge rate. These charges shall compound and interest will accrue on the total outstanding balance at the end of each month.
If the invoice remains unpaid from the invoice date, then this invoice may be referred to the Victorian Civil and Administrative Tribunal (VCAT) for a tribunal hearing to determine the claim and outstanding amount. Any applicable administration fees and VCAT fees incurred will be payable by the client to the extent permitted by law.
Definitions
In the Terms and Conditions detailed below, the words supplier and client will have the following definitive meaning:
Supplier: refers to WASTEM8 as being the service provider.
Client / Customer: refers to the person(s) or company named on the booking / delivery docket responsible for hiring the WASTEM8 service. If the client comprises more than one person, written expression will include each of them jointly and severally.
Household Waste: refers to household items such as whitegoods, furnishings and domestic electrical equipment. This includes but is not limited to clothing, electronics, bedding, cardboard, timber goods, kitchenware and bathroom items. This does not include any furniture that is dismantled, including disassembled office furniture or laminated and treated timber products, which by nature of disassembly are classed as Commercial & Industrial Waste.
Commercial & Industrial Waste: refers to bulky or heavy-duty items typical of commercial worksites. This includes but is not limited to bricks, steel, dirt, clay, tiles, plaster, heavy timbers and other materials relating to renovating, building or excavating in addition to food waste. This includes any commercial or domestic furnishings disassembled or otherwise broken down in such a way that it is laborious to reassemble or otherwise unable to be used as furniture without further reparation.
Cubic Metre: refers to a volume of area of waste being equivalent in size to 1m (H) x 1m (W) x 1m (D). For example, a standard 6 x 4 trailer (water level) is equivalent to 0.5 cubic metres. Our volume charges are measured once goods are collected and loaded into our trucks. All cubic metre charges are based on the volume of goods as loaded in our vehicles and only charged for goods collected.
Hazardous Materials: refers to materials that cannot be collected or disposed of through our WASTEM8 services such as paints, pesticides, chemicals, oils and fuels, cleaning or polishing chemicals, asbestos, explosive substances or toxic waste.
HVAC Waste: refers to waste generated solely from the HVAC system installation associated with the booking date. This includes ductwork, fittings, cardboard, packaging, general installation waste, small pallets, small metals and evaporative units. It does not include waste from previous installations, property-owner waste or any other unrelated waste.
Terms & Conditions
How our Pick-ups Work
WASTEM8 operates Rear Lift Crusher Trucks specialised for HVAC waste strip-outs.
We arrive within one of two available time windows:
Day-after-install pickup: 8:00am – 6:00pm.
Same-day install pickup: 12:00pm – 6:00pm.
The client must ensure all HVAC waste is placed out the front of the property, at the building line and on private property rather than council property, and is fully ready for collection at the start of the selected pickup window.
WASTEM8 trucks cannot enter driveways or access the rear of the property.
How Much Waste Do You Take?
The standard HVAC pickup includes waste from one HVAC installation, up to a 20-outlet gas system plus one evaporative unit, including associated ductwork and installation waste.
Any waste beyond the standard pickup allowance will require a separate quotation and may incur additional charges.
What We Take
WASTEM8 accepts:
Ductwork, fittings, cardboard, packaging, general installation waste, small pallets, small metals and evaporative units.
What We Don’t Take
WASTEM8 does not accept:
Vapes, lithium batteries, AC units, gas units, bricks, concrete or any hazardous waste, including liquids, asbestos or chemicals.
We do not collect any waste unrelated to the HVAC system being installed on the booking date. This includes waste from previous installations, previous jobs or property-owner waste.
No Vapes Or Lithium Batteries
Vapes and lithium batteries can cause fires and must not be included with your HVAC waste. Please advise WASTEM8 field staff immediately if these items are present.
Quotation of service required and vehicle provided is an estimate only and is solely based upon the verbal descriptions provided by the client of the volume of waste to be collected, or, where available, from the photos provided to us. Any additional volumes of waste to be collected outside of the quoted amount will incur additional charges based on the nature, volume and classification of waste collected.
Additional waste outside the standard HVAC pickup allowance must be quoted separately by WASTEM8 prior to collection where reasonably identifiable.
Full payment is required within 7 days of the WASTEM8 service or the day’s works, unless otherwise agreed in writing or a commercial account has been established. The client agrees to pay for any additional services or waste outside the agreed booking scope.
The client agrees that the waste collected by the supplier does not contain any items considered to be hazardous materials, either defined in this agreement or under applicable local, state or federal laws. A more detailed definition of hazardous materials or contamination can be found by reviewing applicable Federal and State Government regulations.
It is absolutely prohibited to include any type of asbestos materials as part of the service – no exceptions.
Vapes and lithium batteries are also strictly prohibited due to fire risk.
Additional charges will be paid by the client to the supplier for the safe and legal disposal of items deemed by WASTEM8 to be prohibited waste materials should these be concealed or otherwise inadvertently collected by the supplier. The additional charges levied compensate the supplier for the additional cost of disposal of the contaminated contents, the clean-up and/or relevant decontamination of the supplier premises or vehicles.
On the nominated collection day, the client agrees to arrange unobstructed access to the waste for collection. All waste must be positioned at the front of the property at the building line and ready for collection at the start of the selected pickup window.
WASTEM8 trucks cannot enter driveways or access the rear of the property.
If the waste is not positioned at the required collection point, a fee of $85 will apply.
If access is fully blocked, prohibited items are included, or the pickup cannot proceed due to circumstances within the client's control, the pickup may be rejected and a $150 call-out fee will apply.
Note on PM Slots
PM pickups are limited and fill quickly. To secure a PM pickup, clients should book early. If the selected PM run is full, WASTEM8 may move the pickup to the following day. WASTEM8 will text the client first to confirm any changes.
Your quoted WASTEM8 service fee includes the applicable WASTEM8 crew, a WASTEM8 Rear Lift Crusher Truck and the required travel time to and from the property, subject to the standard pickup allowance and access requirements outlined in these Terms & Conditions.
In the event that your WASTEM8 service requires additional work outside the standard pickup scope for any reason, including but not limited to obstructed access, inadequate or restricted access, unsafe working locations, shared access with trades and services or waste volumes exceeding the standard allowance, additional charges may apply and will be quoted or communicated by WASTEM8 where practicable.
It is the responsibility of the client to determine the suitability of the chosen area for waste collection. The waste must be placed at the front of the property at the building line, be clear of overhead power lines and cables and be positioned so that it can be safely accessed by the WASTEM8 truck and crew. The client is responsible for ensuring that the location complies with all local laws and does not create a hazard for pedestrians or road users. It is the responsibility of the client to organise any permits applicable to the collection of the waste.
In respect of any additional fees or charges levied by the Supplier, the supplier will notify the client of any changes to the booking quotation via text, phone or email, including but not limited to changes to the size/type of vehicle required, number of vehicles provided, quantity of waste to be collected, frequency of trips needed to complete the service, type of waste and time and date of collection.
Terms of service require payment within 7 days of collection unless a commercial account has been established prior to the service. Commercial accounts are available to ABN holders only for clients with long-term service requirements and are subject to approval, including verification of account and third-party credit checks.
For any additional charges incurred in relation to a booking, such as additional waste collection fees, access fees or call-out fees, payment is required in accordance with the payment terms specified on the applicable invoice.
In the event that the supplier has not been paid in full (and no payment arrangements have been made) after a reasonable amount of time, the client agrees that the supplier can dump a similar amount of rubbish to what was originally collected back to the client’s site address without notification, to the extent permitted by applicable law.
For clients with a pre-arranged credit account, the client may choose to terminate their booking if they no longer require their WASTEM8 collection. The client must give written notice to the supplier prior to the intended termination date, but only once all outstanding amounts owing to the supplier have been paid in full by the client.
Any client accounts exceeding the agreed trading terms by greater than 30 days are subject to a late payment fee. Late payment fees are levied at the rate of 5% of the total invoice amount for accounts greater than 30 days late. Accounts exceeding 60 days and remaining unpaid are subject to debt collection action. The supplier reserves its right to provide details of the client account to third-party agencies for recovery action. Clients with commercial accounts exceeding the 30-day trading terms shall be placed on hold and unable to book or receive services until payment is brought within the agreed terms.
In the event that extended payment terms are offered as a result of a booking extending over multiple days due to size or complexity, a progress payment is required after two days of works, prior to commencement of any further works. Further works are required to be paid daily thereafter.
All credit card payments may incur an extra surcharge of up to 3%. Charges are as levied by the third-party payment provider nominated by the supplier and are subject to change.
By accepting the booking and paying for the WASTEM8 service, the client hereby agrees to indemnify the supplier against all possible damages, claims and lawsuits relating to the engagement of WASTEM8, to the extent permitted by law. This includes but is not limited to claims for loss of income, personal injury, environmental damage or property damage.
The Supplier shall not be held liable for any loss, damage, injury or death arising either directly or indirectly from the performance of its employees or contractors, except to the extent that such liability cannot lawfully be excluded or limited.
Your booking, payment and acceptance of the WASTEM8 service is an implied acceptance of the above Terms and Conditions. Our Terms and Conditions are subject to change, and it is the client’s responsibility to ensure they have read and acknowledged the terms as displayed at https://wastem8.net.au/ prior to proceeding.
Changes and Cancellations
Changes or cancellations require at least 24 hours’ notice.
Cancellations made within 24 hours of the scheduled pickup may incur a $150 cancellation fee.
